Acceptable Use Policy

1. Scope

This Acceptable Use Policy ("AUP") governs the use of all products, services, APIs, and platforms provided by Nubio Deep Intelligence Pte. Ltd. ("Nubio," "we," or "our") (collectively, the "Services"). This AUP is incorporated into and supplements the Nubio Terms of Use and any applicable Master Services Agreement ("MSA"). Where an executed MSA conflicts with this AUP, the MSA prevails.

This AUP applies to all customers, their authorised users, employees, contractors, and any party accessing the Services through customer-provided credentials or API keys ("Users"). Customers are responsible for ensuring their Users comply with this AUP.

Nubio may update this AUP at any time. Material changes will be notified at least thirty (30) days in advance via email or in-platform notification. Continued use after the effective date of any update constitutes acceptance.

2. Prohibited Conduct

The following are strictly prohibited. This list is illustrative; Nubio may determine in its sole discretion whether any conduct violates this AUP.

2.1 Unauthorised Access and System Integrity

Users must not:

• Attempt to gain unauthorised access to the Services, any Nubio systems, or any data belonging to other customers or tenants.
• Access or attempt to access accounts, environments, or data beyond the scope of their authorisation.
• Circumvent, disable, or interfere with access controls, authentication mechanisms, rate limits, usage quotas, or security measures.
• Introduce malicious code, viruses, or harmful software into the Services.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, model weights, or proprietary logic of the Services.
• Perform penetration testing, vulnerability scanning, or load testing against the Services without prior written authorisation from Nubio.

Violations may result in civil action and criminal prosecution under the Computer Misuse Act 1993 (Cap. 50A), which provides for fines up to S$50,000 and imprisonment up to 7 years.

2.2 Data Misuse

Users must not:

• Input personally identifiable information ("PII") into the Services without an appropriate data processing agreement in place with Nubio and a valid legal basis for processing under the Personal Data Protection Act 2012 ("PDPA").
• Process regulated data categories (including health data, biometric data, financial data, or children's data) through the Services without prior written authorisation from Nubio.
• Share platform outputs, data, or analyses with unauthorised third parties or any party not covered by the applicable MSA.
• Attempt to extract training data, model weights, or proprietary information from the Services through any method.

2.3 AI Interface Misuse

Users must not:

• Engage in prompt injection, jailbreak attempts, or any technique designed to subvert the intended behaviour or safety boundaries of any AI component of the Services.
• Use AI interfaces to extract proprietary information about Nubio's systems, architecture, or trade secrets.
• Conduct automated scraping, bulk querying, or programmatic extraction from AI interfaces beyond documented API access.

2.4 Harmful or Unlawful Use

Users must not:

• Use the Services for any purpose that violates applicable law in any jurisdiction where the User operates.
• Use AI-generated outputs for safety-of-flight decisions (including airworthiness, maintenance go/no-go, or flight dispatch) without qualified human review and authorisation.
• Use platform outputs to implement discriminatory practices based on protected characteristics under applicable law.

3. AI Governance and Human Oversight

The Services include AI and machine learning components that generate predictions, recommendations, and analyses based on data inputs and computational models.

Users acknowledge that:

• AI-generated outputs are decision-support tools and do not constitute professional advice. Users are responsible for all decisions made using the Services.
• Appropriate human oversight must be maintained for all workflows where AI outputs may affect safety, regulatory compliance, or material business outcomes.
• Elevated levels of AI autonomy within the Services require separate written agreement between the Customer and Nubio, including completion of an operational readiness assessment.

4. Personal Data

Nubio processes personal data in accordance with the PDPA and our Privacy Policy. Where the Services process personal data on behalf of a Customer, a data processing agreement will govern the terms of that processing.

Data Breach Notification: In the event of a data breach that Nubio determines is notifiable under the PDPA, Nubio will notify affected individuals and the Personal Data Protection Commission ("PDPC") within 3 calendar days of that determination. Nubio will complete its assessment of whether a breach is notifiable within 30 days of becoming aware of the breach.

Consent: Nubio does not require Users to consent to personal data processing beyond what is reasonably necessary to provide the Services.

5. Reporting Violations

Users who become aware of any actual or suspected violation of this AUP should report it to legal@nubio.world with a description of the suspected violation. Nubio will acknowledge receipt and initiate an investigation within five (5) business days. Nubio will not retaliate against any User who reports a violation in good faith.

6. Consequences of Violation

Nubio may take any of the following actions in response to a violation, proportionate to its severity:

1. Warning and remediation with a defined timeframe.
2. Temporary suspension of access pending investigation.
3. Permanent termination of access and the applicable agreement.
4. Legal action, including injunctive relief and damages.

Nubio shall not be liable for any losses incurred by a User as a result of suspension or termination due to a violation of this AUP.

7. Governing Law

This AUP is governed by the laws of the Republic of Singapore. Disputes shall be resolved in accordance with the dispute resolution provisions of the applicable MSA or, in its absence, the Nubio Terms of Use.
